Use of Web Site Content

ezHomeService authorizes You to view and access a single copy of the content available on or from ezHomeService.com (the "Web Site") solely for your personal, noncommercial use.

The contents of this Web Site, and of all other websites under ezHomeService’s control, whether partial or otherwise such as text, graphics, images, logos, button icons, software and other Web Site content (collectively, "Web Site Content"), is the property of ezHomeService or its content suppliers or clients. The compilation (meaning the collection, arrangement and assembly) of all content on this Web Site is the exclusive property of the Company. ezHomeService Security Rules

Users are prohibited from violating or attempting to violate the security of ezHomeService, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to ezHomeService, overloading, "flooding", "spamming", "mailbombing" or "crashing", (d) sending unsolicited e-mail, including promotions and/or advertising of products or services, or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

Use of Contact Information

ezHomeService may be used only for lawful purposes by Service Requesters seeking Contractor/Vendor services and Contractors/Vendors seeking service requests. While registering and entering a service request on ezHomeService, You are required to disclose contact information, service request address information, and the type of service you are requesting. This information will be made available to registered member Service Providers who will use it to contact You via email, telephone, mail, or other reasonable means in reference to your request. This information is also historically retained on the Web Site and is available to all registered member Service Providers who had access to your original service request. This information will also be used by ezHomeService to service your account, to reasonably address matters pertaining to your account, and for other purposes reasonably related to your service request and our business. By providing this information to ezHomeService, You consent and approve sharing this information even if you are a member of a local, state, or federal “Do Not Call” list. Specific Prohibited Uses

Because your personal information will be critical in providing You, the Service Requester, the best service possible, any submission of false or inaccurate personal or service request information is prohibited. Any issues or disputes that arise from the false posting of information will not be the responsibility of ezHomeService.

Deleting or revising any material posted by any other person or entity is prohibited.

Using any device, software or routine to interfere or attempt to interfere with the proper working of ezHomeService or any activity being conducted on this site is prohibited.

Taking any action which imposes an unreasonable or disproportionately large load on ezHomeService’s infrastructure is prohibited.

If You have a password to this Web Site, disclosing to or sharing your password with any third parties or using your password for any unauthorized purpose is prohibited.

Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search ezHomeService, is prohibited.

Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of ezHomeService is prohibited.

Aggregating, copying or duplicating in any manner any of the Web Site Content or information available from ezHomeService is prohibited.

The Company’s Liability

ezHomeService.com is only a venue. This Web Site acts as a venue for Service Requesters to post service requests and Service Providers to view and respond to said requests. The Company is not involved in the actual transaction between Service Requesters and Service Providers. As such we do not guarantee that we will be able to match your service needs with a suitable Contractor/Vendor or that there are Contractor/Vendors in your area that are capable or willing to accept your service request.. 

ezHomeService makes no guarantees or representations regarding the skills or representations of Contractors/Vendors or the quality of the job that he or she may perform for You if You elect to retain their services. We also make no guarantees regarding the accuracy and validity of representations made by a Contractor/Vendor regarding licensing, bonding, professional credentials, or any other such representations he or she may make as it pertains to the suitability of servicing your request.

Before entering into any service agreement, it is always recommended You perform all necessary due diligence on the Service Provider.  ezHomeService does not endorse or recommend the services of any particular Contractor/Vendor. It is entirely up to You to enter into a direct contract or otherwise reach agreement with a Contractor/Vendor, and we do not guarantee or warrant their performance on the job or the outcome or quality of the services performed. The Contractors/Vendors are not employees or agents of ezHomeService, nor is ezHomeService an agent of the Contractors/Vendors. ezHomeService does not perform, and is not responsible for, any of the services requested by You in your service request. Your rights under contracts You enter into with Contractors/Vendors are governed by the terms of such contracts and by applicable federal, state, provincial and local laws. Should You have a dispute with any Contractor/Vendor, You must address such dispute with the Contractor/Vendor directly,

AND YOU HEREBY AGREE TO RELEASE EZHOMESERVICE (AND OUR OFFICERS, DIRECTORS, AFFILIATES, EMPLOYEES AND AGENTS) FROM ANY DAMAGES OR CLAIMS (INCLUDING CONSEQUENTIAL AND INCIDENTAL DAMAGES) OF EVERY KIND OR NATURE, SUSPECTED AND UNSUSPECTED, KNOWN AND UNKNOWN, AND DISCLOSED OR UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES AND YOUR DEALINGS WITH SERVICE REQUESTERS.

Because user authentication on the Internet is difficult, ezHomeSerivce cannot and does not confirm that each Service Provider is who they claim to be. Because we do not and cannot be involved in Service Requester-to-Service Provider dealings or control the behavior of participants of ezHomeService, in the event that You have a dispute with one or more users, You release ezHomeService (and our agents and employees) from claims, demands and damages (actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

The Web Site Content may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of ezHomeService and the Web Site Content. The use of ezHomeService and the Web Site Content is at your own risk. Changes are periodically made to ezHomeService and may be made at any time.

THE COMPANY DOES NOT WARRANT THAT EZHOMESERVICE WILL OPERATE ERROR-FREE OR THAT EZHOMESERVICE AND ITS SERVER ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. ezHomeService reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your postings from this Web Site, immediate termination of your registration with or ability to access this Web Site, and/or any other service provided to You by the Company, upon any breach by You of these Terms and Conditions or if the Company is unable to verify or authenticate any information You submit to the Web Site.

Indemnity

You will also be able to store information such as service request history and Service Requester history for contacts you have made through the Web Site. Some of this information will be sent to Homeowners in connection with their service request(s). Depending on your membership level, this information may also be available to Service Requesters through the ezHomeService Search facility. This information will also be used by ezHomeService to service your account, to reasonably address matters pertaining to your account, and for other purposes reasonably related to your membership and our business. By providing this information to ezHomeService, You consent and approve sharing this information even if you are a member of a local, state, or federal “Do Not Call” list. The Service Requesters are not employees or agents of ezHomeService, nor is ezHomeService an agent of the Service Requesters. ezHomeService does not perform, and is not responsible for, any of the services rendered by You in fulfilling a service request. Your rights under contracts You enter into with Service Requesters are governed by the terms of such contracts and by applicable federal, state, provincial and local laws.
